I saw Levon play the Weight over fifteen years ago at Queens College- outdoors no less! very tasty!!

I do not have a T.V. so I have not seen the commercial.

WOODSTOCK, N.Y. - Levon Helm, former drummer for The Band, is suing a Manhattan advertising firm over the use of the band's signature song, "The Weight," in a television commercial.
In a lawsuit filed in state Supreme Court in December, Helm asks for information about BBDO Worldwide's profits from the commercial for Cingular cell phone service and for financial compensation for the use of his performance.
Helm's attorney, Michael Pinsky, said state law prohibits the use of a celebrity's voice or likeness for profit without his prior written permission.
Pinsky said Helm received a royalty payment from the use of "The Weight" in the commercial, but doesn't feel he has been adequately compensated.
According to an annual royalty statement from EMI Records, which owns Capitol Records, The Band's record label, Helm took home one-fifth of half of the licensing fee that BBDO paid to Capitol for the right to use the song, Pinsky said.
A BBDO spokesman declined comment.
"It was just a complete, damn sellout of The Band — its reputation, its music; just as much disrespect as you could pour on Richard and Rick's tombstones," said Helm, 66, a longtime Woodstock resident.
Richard Manuel, vocalist and piano player for The Band, died in 1986. Rick Danko, who played bass, died in 1999.
The Band was inducted into the Rock and Roll Hall of Fame in 1994.

did u attend Queens college? I only ask cause I'm wondering if u checked out any "lingering" remnants of the boys stop there in late 69/early 70?

Yeah, but I attended in the 1980's when the Campus was to put it mildly Reaganified. Not that we didn't have fun anyway!

Hey Ducats,

It is funny you should mention that. Our little group of Heads was 'persona non grata' at the Music Center so we used to hang out in the adjoining outdoor amphitheathre where every day was a new acoustic adventure depending on who showed up and what musical and other blessings they brought with them.

The place the Dead played in is less than 3000 seats and back when the Dead played there it was brand new. It was still in good shape when I was going there in the 80's, very good acoustics, built for classical music.

We were seriously the Freaks on campus!

I don't know what the protection laws are for vocalists but since Robbie Robertson wrote the tune I would think he covered his bases when he made the deal. While I like Robbie as a musician I get the felling he was trey anastasio before Trey was Trey if you know what i mean.

Composer rights and performer rights are two different things. And whether Robbie actually owns the rights, I do not know (in those days, the rights were held by publishing companies). Robbie could perform it on a commercial without Levon's permission. Levon, however, would have to clear it with Robbie.

Everything is kool 'in the underworld of RedBoy' even before Dylan stopped by, visited, said he'd return, but hasn't. That was 32 years ago. The Elders still waiting for him to keep his word. Maybe we'll get to Hong Kong before the DP special roles in. Nothing like creating your own dead show........they're rewriting history as well.

If I had a guess, I would say that Robbie Robertson cut a deal for the advertisement without Levon's involvement, prolonging the feud to Hatfield & McCoy proportions. It's a shame he's become so embittered, but probably rightfully so.

I know Levon lives up in Woodstock but where is Robbie at?
This is one Band that we probably won't see anytime soon.
